This Privacy Policy (“Privacy Policy” or “this Policy”) sets forth how personal and other information, is collected, used, and disclosed in connection with the Services of 7Teenth Street Holdings Inc. d/b/a/ Heartland Lotto, its affiliates and subsidiaries (collectively referred to as, “Heartland Lotto”, “Heartland”, “we”, “us”, “our”, or “Company”), as well as its agents, contractors and any parties involved in creating, producing or delivering the App. By using our Services, You are consenting to the collection of information and use practices described herein. This Privacy Policy applies to all information collected on or through our App (collectively, the “Services”) and to information collected when You contact Heartland Customer Support directly via any mode of communication (e.g., email, telephone, SMS message, social media accounts, websites, digital platforms, etc.) By accessing and using our Services, You acknowledge and agree to collection, use, and disclosure of Your information in accordance with this Policy. If You do not agree to the processing of Your personal information as outlined in this Policy, please do not provide it when requested. All information collected on Your Account will be used consistent with this Policy.
1. Sources of Personal Information
Directly from You - Heartland may collect personal information from You during Your access and use of our Services or App, such as during account creation, making a deposit, requesting a withdrawal, placing an order, signing up for marketing, participating in promotions, contacting our Customer Support team, and/or any other contact or communication You may have with Heartland staff.
From Others - Others may provide Your personal information, if You so consent, in connection with a referral program or other purposes. You may only provide information about another person, if You have that person’s consent.
Cookies & Similar Technologies - Heartland and its service and third-party providers may use cookies, web beacons, and similar tracking technologies to collect information when You interact with our Services, such as Your device, internet usage, cookie identifiers, location, website activity, and other details. As a result, third-party companies may utilize tracking technologies/cookies that we link to and third-party service providers that assist us with various aspects of our Services. We are not responsible for our third-party providers’ use of tracking technologies.
Service Providers - Heartland may collect personal information from service providers who assist us in providing our Services and App, as well as to assist in providing customer assistance.
Other Third Parties and Publicly Available Information - Heartland may collect personal information from other third parties and from publicly available sources that provide information to us, such as from third-party providers, advertising networks, data brokers, government and other public sources. We may supplement information collected directly from You with outside records provided by these third parties for advertising and marketing purposes, as well as to provide our Services, perform verification, authentication, fraud detection, and comply with legal and regulatory requirements. If You login to utilize our Services through a third-party or social media account, we may collect information from that platform or service.
2. What Information We Collect
The Company collects a variety of information including what You provide to us when You register an account and use our products and Services, what You communicate with us, and other available information about You that exists through publicly available sources, third-parties or on social media platforms and websites. We collect personal information related to:
Account and Registration Information - This includes information like Your first and last name, date of birth, email address, phone number, physical address, government-issued identification number (like a copy of Your driver’s license, state-ID, passport or Your Social Security Number), Your username and password, signatures, and Your physical characteristics or a description of You. This also includes Your GPS location information to comply with our legal obligations.
Communications - We may collect information when You communicate with us through social media platforms or directly by participating in surveys, upload attachments, or otherwise correspond with us online. For example, if You require customer service or request additional information about our Company, we will collect Your information including Your name, the date, time, and subject of communications. We may also collect information about Your social media usernames or platform handles or if You sign up to receive alerts, or promotional messages or materials, or inquire about career opportunities.
Financial and Payment Information - To provide You with our Services, we, or our third party providers, may collect Your payment and financial data. This may include bank account number and routing number, PayPal and Venmo account information, and Apple Pay information. It could also include Your credit or debit card information. We do not store Your complete banking account number or payment card number on our systems. For Your awareness, we may receive the current balance of the bank accounts You link to the Service at any time.
Automatic Collection - When You use our Services, we may collect certain information by automated means, like cookies, pixel tags, web server logs, and other similar technologies. We may collect information including but not limited to, Your browser and search history and if You interact with communications we send to You. We also collect information about Your visits to our products or utilization of our Services, including the websites and searches You use before engaging with us and the duration of Your engagement including what You searched for, scrolled over and through and as well as clicked on. We also collect information about web page and app response times and download errors. We also may collect information about the device You utilized our products and Services from, including the type, model, file names and versions, device identifier, operating system, serial numbers, device motion information, mobile network, Your Internet Protocol (IP) address, domain name, and/or a date/time stamp and geo-location information for all mentioned actions.
3. How We Use Information
We may use the information we collected from You for these and other unstated reasons:
  • To verify and confirm Your Account information to comply with any applicable legal requirements;
  • To provide You with Services, products, and actions You request;
  • To respond to Your inquiries or provide You with customer service;
  • To provide You with changes to the Terms which may be provided through push notifications, text messages or emails;
  • To send You marketing communications via push notifications, text messages, and email;
  • For the Company’s business reasons which may include, but are not limited to changing or improving our Services and products, manage risk, identifying trends of use and effectiveness of promotions, enforcing Terms, perform audits, developing new products, check for fraudulent activity and take steps to prevent it, data analysis, manage information technology infrastructure, operate and expand business activities, protecting our interests and Services and our users;
  • To comply with our legal or regulatory obligations, to establish or exercise our rights, and to defend against a legal claim;
  • In connection with a corporate transaction, including in connection with a sale, acquisition, merger, change of control, bankruptcy, or similar transaction involving some or all of our assets, or due diligence related to such transactions;

  • To use de-identified, anonymized, or aggregated versions of your personal information for any purpose; and
  • From time-to-time for such other purposes as You may consent in accordance with this Privacy Policy or Terms.
4. How We Share Information
In addition to the other circumstances discussed in this policy and in the Terms, we disclose information about You in the following situations:
  • With our corporate affiliates who include, parents, subsidiaries, affiliates, agents, contractors and any parties involved in creating, producing or delivering the App, joint ventures or other companies under common control;
  • With third-party vendors who assist us when providing our Services, like payment processing, so users can deposit and withdraw funds, or to craft marketing and advertising strategies;
  • With third-parties that perform services to support our business and internal operations, such as with entities that may help facilitate Services, perform data analysis, assist with customer service, send You emails and/or text, provide audit services, or assist with the other actions in this policy;
  • With other third-parties to comply with our legal and regulatory obligations under applicable law because of valid court orders, government investigations or inquiries, subpoenas or in connection with any other legal process, to comply with relevant laws and regulations or to defend against legal claims;
  • With other third-parties to protect the safety and security of our users and to detect and protect against fraud to protect or exercise the rights of our company, employees, agents, and affiliates, and to act regarding possible illegal activities or violations of our policies;
  • With a company who us acquiring, or plans to acquire our company, business, or our assets, including at the negotiation stage; and
  • With other third-parties who are not described elsewhere in this policy.
5. Data Retention
Heartland will retain your personal information for as long as necessary to fulfill the purposes outline above, unless we are required to do otherwise as prescribed by applicable law.
    6. Your Choices
    As one of our registered users, You can change and update Your personal information by logging into our App or emailing our team at support@heartlandlotto.com. You are responsible for ensuring that all information within Your Account is accurate and up to date. We reserve the right to verify any information You provide to us to meet our legal obligations.

    If You close Your Account we may retain Your personal information in order to prevent fraud, resolve disputes, for responsible gaming purposes, to meet our legal obligations, to enforce these Terms and for any other necessary business purpose. 

    You may receive promotional emails and/or text messages from us. You can opt out of receiving these communications by following the unsubscribe instructions or prompts provided. Please know it may take 5 business days for Your request to be processed.  If You choose not to receive promotional emails or texts, we may still send You service- related communications.

    You can follow the instructions in Your browser settings if You wish to reject or recover browser cookies. Unless You change Your settings, many browsers accept cookies by default. Please note that if You set Your browser to disable cookies, our Services may not work properly.
      7. How We Protect Information
      Heartland acknowledges that the security of Your information is very important. We utilize commercially reasonable standards to protect Your personal information from unauthorized use or disclosure including the encryption of Your password, payment information, and any other sensitive personal information that may require encryption to ensure specific industry standards. However, no internet based transaction or electronic communication or storage is absolutely secure and we cannot guarantee or warrant the security of Your personal information, therefore You provide it to us at Your own risk.
      8. Children’s Privacy
      Heartland does not knowingly collect personal information from any child under 13 years of age, if the personal information of a child under the age of 13 is collected or provided to us, it will be destroyed. Children under the age of 13, are not to use our App or provide any information through our Services. Further, any transactions through our Company are limited to those users who meet applicable age minimums in each jurisdiction.       9. International Data Transfers
      Heartland’s Services are only available in the United States. For Your awareness, if You access our Services from any country outside of the United States, You understand that Your personal information will be transferred to the United States and that Your use of the Services will be governed by U.S. law, this Privacy Policy, and our Terms.
      10. Third Party Links
      While using our Services, You may be provided with links to the websites of third-party companies that we do not control or operate, which may include our partners, advertisers, and affiliates. If You follow a link to any of the third-party websites, they may have their own privacy policies and we do not accept any responsibility or liability for these policies or these third-parties’ use, collection or disclosure of Your information. We recommend that You carefully review any applicable privacy policies of the third party entities before You submit any personal data to these websites
      11. Changes to This Privacy Policy
      Heartland may update this Privacy Policy and Terms from time-to-time. In the event of conflict between this Policy and the Terms, the Terms will control. Please revisit this page to stay aware of any changes. If a revision to this Privacy Policy, in our sole discretion, is material, we will notify You through the email address associated with Your Account and/or we may provide notice to You within the App itself where we may require You to acknowledge such changes. For non-material changes, where Your acknowledgement is not required, Your continued use of the Services constitutes Your acceptance of the Policy as amended.
